Agreement to Terms

By accessing or using the ControlShift AI application ("ControlShift AI," "the App," or "the Service") available at app.controlshiftai.com, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the ControlShift AI application or Service.

Description of Service

The ControlShift AI application provides AI-powered Chat Agent and Voice Agent platforms, automation tools, CRM and marketing intelligence, and related services. The platform includes integrations with third-party services such as Google, Facebook, WhatsApp, TikTok, LinkedIn, Twitter/X, and other business tools.

User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account
• You must notify us immediately of any unauthorized use of your account

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Transmit any harmful code, viruses, or malicious software
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use the Service to spam, harass, or harm others
• Violate any third-party rights, including intellectual property rights

Third-Party Integrations

Our Service integrates with third-party services (Google, Facebook, WhatsApp, TikTok, LinkedIn, Twitter/X, etc.). Your use of these integrations is subject to the respective third-party terms of service and privacy policies. We are not responsible for the practices of third-party services.

Intellectual Property

The Service and its original content, features, and functionality are owned by ControlShift AI Pty Ltd and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or reverse engineer any part of the platform except as expressly permitted.

Payment Terms

• Subscription fees are billed in advance on a recurring basis
• Refunds are handled according to our Billing & Refund Policy
• We reserve the right to change our pricing with 30 days notice
• Failure to pay may result in suspension or termination of your account

Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or modifications that may temporarily interrupt service.

Limitation of Liability

To the maximum extent permitted by law, ControlShift AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Indemnification

You agree to indemnify and hold harmless ControlShift AI from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may cancel your subscription at any time from your account settings.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
